Issues with the death - applying for probate

In order to apply for probate, it will be necessary to provide the original or a certified copy of the death certificate for the deceased to the Court. You can obtain the death certificate from the Registry of Births, Deaths and Marriages in the state where the deceased died. If the the death certificate is not in English, then it will be necessary to obtain a translation.  

If the deceased lived or died in a foreign country, then you should seek formal legal advice. 

If the death possibly happened as a result of murder, then the Court usually requires further evidence that theExecutorandBeneficiarieswere not involved in the murder or are not suspects in the police investigation. If no body has been found or the death possibly happened as a result of foul play, then you should seek legal advice from a qualified person.
