Common Questions about Divorce

How do I apply for Divorce?

To apply for a Divorce, the appropriate forms need to be filled out and an application made to the Court. All applications for Divorce must now be made in the Federal Circuit Court. To 'file' your Divorce Application, means to submit to the Court. This can be done by post, in person or online.

What are the eligibility requirements?

To be eligible to apply for a Divorce in Australia you must:

  1. Be an Australian citizen;
  2. Regard Australia as your home and intend to live in Australia indefinitely; OR
  3. Ordinarily live in Australia and have done so for 12 months immediately before filing for Divorce;
  4. Be separated for at least 12 months
  5. Be married for more than 2 years

How much does it cost?

There is a fee to file for Divorce. The current fee is $865, however, the fee can be reduced to $290 in cases of financial hardship. The kit includes the separate application form to apply for a reduction of the fee.

Who applies for a Divorce?

There are 2 different ways to apply for a divorce. Either by a:

  1. Sole application - if you are applying by yourself; or
  2. Joint application - if you are applying together with your spouse.

If you make the application solely, you must ‘serve’ the application on your spouse, after it has been lodged with the Court. ‘Serve’ means ensuring that the other party has received the application and is aware of it.
